Abstract
Perkembangan sektor properti mendorong maraknya transaksi jual beli properti secara inden di Indonesia. Transaksi ini melibatkan objek yang belum tersedia secara fisik, sehingga menimbulkan kebutuhan akan kepastian dan perlindungan hukum, khususnya bagi konsumen. Penelitian ini bertujuan untuk menganalisis peran dan tanggung jawab notaris dalam transaksi jual beli properti inden dari perspektif hukum perjanjian. Penelitian menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan konseptual, serta wawancara dengan notaris sebagai data pendukung. Data dikumpulkan melalui studi pustaka terhadap KUH Perdata, UU Jabatan Notaris, UU Perlindungan Konsumen, dan regulasi perumahan. Hasil penelitian menunjukkan bahwa notaris memegang tanggung jawab penting dalam memastikan terpenuhinya syarat sah perjanjian sebagaimana diatur dalam Pasal 1320 KUH Perdata dan asas-asas hukum perjanjian. Notaris juga bertugas menyusun akta otentik, memverifikasi legalitas dokumen, menjelaskan isi perjanjian secara transparan, serta menolak klausul yang merugikan konsumen sebagaimana diatur dalam Pasal 18 UU Perlindungan Konsumen. Dalam hal ini, akta PPJB memiliki kekuatan pembuktian sempurna sekaligus memberikan perlindungan hukum konkret. Dengan demikian, notaris berperan sebagai penjaga kepastian, keadilan, dan perlindungan hukum dalam transaksi jual beli properti inden. / The rapid growth of the property sector in Indonesia has led to the increasing practice of off-plan (inden) property sales. These transactions involve properties that do not yet physically exist, thus requiring strong legal certainty and protection, especially for consumers. This research aims to analyze the role and responsibility of notaries in off-plan property transactions from the perspective of contract law. The study employs a normative juridical method using statutory and conceptual approaches, supported by interviews with notaries as additional data. Data is collected from legal literature, including the Indonesian Civil Code, Notary Law, Consumer Protection Law, and housing regulations. The results indicate that notaries have a crucial role in ensuring the validity of agreements in accordance with Article 1320 of the Civil Code and core principles of contract law. Notaries are responsible for drafting authentic deeds, verifying document legality, explaining contract terms transparently, and rejecting clauses that disadvantage consumers as mandated by Article 18 of the Consumer Protection Law. The PPJB deed provides not only perfect evidentiary value but also concrete legal protection. Thus, notaries serve as key actors in upholding legal certainty, fairness, and protection in off-plan property sale transactions.
