Abstract
Penelitian ini bertujuan untuk menganalisis bentuk tanggung jawab Pejabat Pembuat Akta Tanah (PPAT) terhadap penerbitan Akta Jual Beli (AJB) yang mengandung cacat formil dan materiil, serta memberikan solusi dan langkah pencegahan atas potensi terjadinya pelanggaran dalam proses peralihan hak atas tanah. Penelitian ini menggunakan metode penelitian hukum normatif-empiris, yang menggabungkan kajian terhadap peraturan perundang-undangan, asas hukum, dan praktik pelaksanaan di lapangan melalui wawancara dengan pihak terkait, seperti PPAT dan pejabat Badan Pertanahan Nasional (BPN). Penelitian ini menunjukkan bahwa PPAT memiliki tanggung jawab profesional, etik, administratif, perdata, dan bahkan pidana jika lalai dalam menjalankan kewajibannya, seperti tidak menghadirkan para pihak, tidak memeriksa keabsahan dokumen, atau tidak mematuhi prosedur formil dan materiil sebagaimana diatur dalam UUPA, PP Nomor 24 Tahun 1997, PP Nomor 37 Tahun 1998 jo. PP Nomor 24 Tahun 2016, serta KUH Perdata. Dalam kasus yang diteliti, PPAT menerbitkan AJB tanpa kehadiran ahli waris sebagai pihak yang berhak, sehingga AJB dinyatakan cacat hukum. Penelitian ini merekomendasikan pentingnya penerapan prinsip kehati-hatian dalam pelaksanaan tugas PPAT dan perlunya penguatan pengawasan serta sanksi yang tegas untuk mencegah pelanggaran serupa di masa depan. Temuan ini diharapkan dapat menjadi acuan dalam peningkatan profesionalitas PPAT dan menciptakan kepastian hukum dalam transaksi pertanahan. / This study aims to analyze the responsibilities of the Land Deed Official (Pejabat Pembuat Akta Tanah or PPAT) in issuing a Deed of Sale and Purchase (Akta Jual Beli or AJB) that contains formal and material defects, as well as to provide solutions and preventive measures against potential violations in the process of transferring land rights. The research adopts a normative-empirical legal method, combining the examination of statutory regulations, legal principles, and real practices through interviews with relevant parties such as PPATs and officials from the National Land Agency (Badan Pertanahan Nasional or BPN). The findings indicate that PPATs bear professional, ethical, administrative, civil, and even criminal liability if they fail to fulfill their duties, such as not ensuring the presence of involved parties, not verifying document authenticity, or not complying with formal and material requirements as stipulated in the Basic Agrarian Law (UUPA), Government Regulation No. 24 of 1997, Government Regulation No. 37 of 1998 jo. Government Regulation No. 24 of 2016, and the Indonesian Civil Code. In the case studied, the PPAT issued an AJB without the presence of a rightful heir, resulting in the deed being legally defective. The study recommends the strict application of the precautionary principle in PPAT practices and the enhancement of oversight and firm sanctions to prevent similar violations in the future. These findings are expected to serve as a reference for improving the professionalism of PPATs and ensuring legal certainty in land transactions./
