Abstract

Permasalahan pemenuhan hak atas pekerjaan di Indonesia masih menjadi tantangan, di mana pekerja migran Indonesia kerap mengalami perlakuan tidak layak, seperti penyitaan dokumen dan tindak kekerasan dari majikan. Meskipun pemerintah telah mengesahkan Undang-Undang Nomor 18 Tahun 2017 tentang Perlindungan Pekerja Migran Indonesia, pelaksanaannya dinilai belum efektif, mengingat masih maraknya kasus pelanggaran terhadap pekerja migran, khususnya pekerja migran Indonesia tak reguler yang menjadi korban perdagangan orang. Di tingkat regional, ASEAN telah membentuk ASEAN Convention Against Trafficking in Persons, Especially Women and Children sebagai upaya kolektif dalam penanggulangan perdagangan orang, namun implementasinya masih lemah dan belum mampu memberikan perlindungan yang optimal, khususnya bagi pekerja migran tak reguler yang menjadi korban perdagangan orang. Tesis ini bertujuan untuk menganalisis urgensi pengaturan status dan prosedur identifikasi bagi pekerja migran tak reguler yang menjadi korban perdagangan orang dalam hukum nasional Indonesia guna memperkuat perlindungan terhadap pekerja migran Indonesia tak reguler. Dalam mewujudkan tujuan tersebut, penulis menggunakan metode penelitian hukum berupa penelitian hukum normatif untuk menganalisa berbagai bahan hukum dan data sekunder. Dengan metode tersebut, diketahui bahwa pengaturan di dalam hukum nasional Indonesia masih belum menyinggung mengenai perlindunga bagi pekerja migran tak reguler padahal pemerintah Indonesia telah meratifikasi ketentuan hukum internasional terkait perlindungan pekerja migran. Lebih lanjut, melalui penelitian ini diperoleh pemahaman bahwa keberadaan prosedur atau mekanisme identifikasi merupakan sesuatu yang esensial dalam memberikan perlindungan yang lebih memadai bagi pekerja migran tak reguler yang menjadi korban perdagangan orang. / The issue of fulfilling the right to work in Indonesia remains a persistent challenge, particularly as Indonesian migrant workers frequently face inhumane treatment, such as the confiscation of personal documents and acts of violence by employers. Although the government has enacted Law No. 18 of 2017 on the Protection of Indonesian Migrant Workers, its implementation has been deemed ineffective, as evidenced by the continued prevalence of rights violations—especially against irregular Indonesian migrant workers who fall victim to human trafficking. At the regional level, ASEAN has adopted the ASEAN Convention Against Trafficking in Persons, Especially Women and Children as a collective effort to combat human trafficking. However, the implementation of this convention remains weak and has yet to provide optimal protection, particularly for irregular migrant workers who are victims of trafficking. This thesis aims to analyse the urgency of regulating the legal status and identification procedures for irregular migrant workers who are victims of human trafficking within Indonesia's national legal framework, in order to strengthen protection for this vulnerable group. To achieve this objective, the author employs a normative legal research method to analyse various legal materials and secondary data. Through this approach, it is found that Indonesia’s national legal framework still lacks specific provisions addressing the protection of irregular migrant workers, despite the government having ratified relevant international legal instruments concerning the protection of migrant workers. Furthermore, this research reveals that the establishment of procedures or mechanisms for identification is essential to ensure more adequate protection for irregular migrant workers who are victims of human trafficking.
