Abstract

Notaris dan Pejabat Pembuat Akta Tanah (PPAT) memiliki peran sentral dalam pembuatan akta autentik yang menjadi dasar kepastian hukum transaksi jual beli properti. Namun, kelalaian dalam menerapkan prinsip kehati-hatian dapat mengakibatkan pembatalan akta jual beli oleh pengadilan, yang berimbas pada kerugian hukum bagi para pihak yang terlibat. Penelitian ini bertujuan untuk menganalisis akibat hukum dari pembatalan akta jual beli oleh pengadilan akibat kelalaian Notaris/PPAT serta mengevaluasi implementasi prinsip kehati-hatian dalam pembuatan akta tersebut guna mencegah pembatalan. Metode penelitian menggunakan pendekatan yuridis normatif dengan studi kasus pada putusan Pengadilan Tinggi Mataram serta wawancara terhadap pelaku profesi Notaris/PPAT. Hasil penelitian menunjukkan bahwa perlindungan hukum terhadap akta autentik yang dibuat oleh Notaris/PPAT belum optimal karena ketidakjelasan implementasi prinsip kehati-hatian yang menyebabkan cacat hukum. Kelalaian Notaris/PPAT dalam verifikasi dokumen dan identitas pihak yang bersangkutan dapat menimbulkan sengketa hukum serta pembatalan akta oleh pengadilan. Oleh karena itu, penerapan prinsip kehati-hatian yang ketat dan pedoman yang jelas sangat diperlukan untuk menjaga integritas akta dan kepercayaan publik terhadap profesi Notaris/PPAT. Penelitian ini merekomendasikan penguatan regulasi dan pembinaan profesi Notaris/PPAT agar risiko pembatalan akta dapat diminimalisir. / Notaries and Land Deed Officials (PPAT) hold a central role in the creation of authentic deeds, which serve as the legal basis for certainty in property sale and purchase transactions. However, negligence in applying the principle of due diligence may result in the cancellation of the sale and purchase deed by the court, causing legal losses to the parties involved. This study aims to analyze the legal consequences of the court's cancellation of sale and purchase deeds due to negligence by Notaries/PPAT and to evaluate the implementation of the due diligence principle in deed-making to prevent such cancellations. The research employs a normative juridical approach with a case study on decisions from the Mataram High Court and interviews with Notary/PPAT professionals. The results indicate that legal protection for authentic deeds created by Notaries/PPAT is not yet optimal due to unclear implementation of the due diligence principle, which leads to legal defects. Negligence by Notaries/PPAT in verifying documents and the identity of the parties involved can cause legal disputes and deed cancellations by the court. Therefore, strict application of the due diligence principle and clear guidelines are essential to maintain the integrity of deeds and public trust in the Notary/PPAT profession. This study recommends strengthening regulations and professional development for Notaries/PPAT to minimize the risk of deed cancellations./
