Urgensi penerapan konsep cyber notary pada era teknologi dan komunikasi dengan pemanfaatan sistem digitalisasi pada tata kelola Protokol Notaris tidak terlepas dari rawannya sistem tata kelola Protokol Notaris secara konvensional. Kendala yang dihadapi dalam pengelolaan Protokol Notaris yang secara konvensional sebagai akibat minimnya standarisasi tempat penyimpanan yang menyebabkan seperti hilang, musnah, maupun rusaknya Protokol Notaris dikarenakan berbagai sebab sering dijumpai dalam prakteknya sehingga kebutuhan masyarakat sebagai pengguna jasa dalam pengeluaran salinan, kutipan, serta penggunaan minuta sebagai alat bukti di pengadilan sering mengalami permasalahan. Kendala lainnya juga dijumpai pada proses pengalihan Protokol Notaris dari seorang Notaris kepada pemegang Notaris berikutnya maupun kepada Majelis Pengawas Daerah bagi Protokol Notaris yang sudah berumur 25 tahun atau lebih. Tujuan dari penelitian ini adalah untuk menelusuri potensi pemanfaatan sistem digitalisasi sebagai bagian dari penerapan cyber notary pada era teknologi Informasi dan Komunikasi dalam pelaksanaan Protokol Notaris untuk memastikan terjaganya kepastian dan perlindungan hukum yang tetap berlangsung terhadap akta autentik yang dibuat oleh maupun dihadapan Notaris. Penelitian ini merupakan penelitian hukum dengan jenis penelitian yuridis normatif, dengan pendekatan yang digunakan adalah pendekatan peraturan perundang-undangan, pendekatan konsep, pendekatan kasus dan pendekatan perbandingan. / The urgency of implementing the concept of cyber notary in the era of technology and communication by utilizing a digitalization system in the governance of Notary Protocols cannot be separated from the vulnerability of the conventional Notary Protocol governance system. The obstacles faced in the management of Notary Protocols which are conventional as a result of the lack of standardization of storage places such as loss, destruction, or damage to Notary Protocols due to various reasons are often encountered in practice so that the needs of the community as service users in issuing copies, quotations, and the use of minutes as evidence in court often experience problems. Other obstacles are also found in the process of transfering Notary Protocols from a Notary to the next Notary holder or to the Regional Supervisory Board for Notary Protocols that are 25 years old or more. The purpose of this study is to explore the potential for utilizing a digitalization system as part of the implementation of cyber notary in the era of Information and communication technology in the implementation of Notary Protocols to ensure the maintenance of certainty and ongoing legal protection for authentic deeds made by or before a Notary. This research is a legal research with a type of normative juridical research, with the approaches used being the statute approach, conceptual approach, case approach and comparative approach.
