Abstract
Pejabat Pembuat Akta Tanah (PPAT) memiliki peran krusial dalam menjamin legalitas dan kepastian hukum dalam setiap transaksi jual beli tanah melalui pembuatan akta otentik. Namun, dalam praktiknya sering kali ditemukan bahwa akta jual beli disusun berdasarkan keterangan palsu, seperti pemalsuan tanda tangan atau identitas, yang berujung pada sengketa hukum dan pembatalan akta oleh pengadilan. Penelitian ini bertujuan untuk menganalisis bentuk pertanggungjawaban PPAT dalam pembuatan akta yang didasarkan pada tanda tangan palsu serta akibat hukum yang ditimbulkan dari akta tersebut. Metode penelitian yang digunakan adalah pendekatan normatif dengan studi terhadap putusan pengadilan, terutama Putusan Mahkamah Agung Nomor 1146 K/Pdt/2020. Hasil penelitian menunjukkan bahwa PPAT dapat dimintai pertanggungjawaban secara perdata, administratif, bahkan pidana apabila terbukti lalai atau terlibat aktif dalam pembuatan akta yang mengandung tanda tangan palsu. Penelitian ini merekomendasikan penguatan sistem verifikasi data, peningkatan integritas profesi PPAT, serta reformasi regulasi guna mencegah penyalahgunaan wewenang. Dengan demikian, kehadiran PPAT sebagai pelindung kepastian hukum dapat benar-benar terwujud dalam praktik pertanahan di Indonesia.

Land Deed Officials play a critical role in ensuring the legality and legal certainty of land sale and purchase transactions through the issuance of authentic deeds. However, in practice, cases have emerged where such deeds are based on false information, including forged signatures or identities. These issues often result in legal disputes and annulment of the deeds by the courts. This study aims to analyze the legal liability of Land Deed Officials in drafting deeds based on forged information, as well as the legal consequences arising from such deeds. Using a normative approach and a case study of the Supreme Court Decision No. 1146 K/Pdt/2020, the research reveals that Land Deed Officials can be held legally accountable—civilly, administratively, and even criminally—if proven negligent or complicit in issuing deeds containing false statements. The findings underline the urgent need to strengthen identity verification systems, enforce professional ethics, and improve regulatory oversight to prevent abuse of authority. Ultimately, these efforts are essential to uphold the role of Land Deed Officials in maintaining legal certainty and protecting good-faith parties in land transactions.
