Kajian ini mengkaji tentang implementasi Peraturan Presiden Nomor 33 Tahun 2024 terkait perawatan serta pengoperasian prasarana perkeretaapian milik negara. Kebijakan ini merupakan revisi atas Perpres No. 53 Tahun 2012 yang sebelumnya mengatur kewajiban pelayanan publik serta pengelolaan barang milik negara di sektor perkeretaapian. Fokus utama dalam kajian ini ialah bagaimana pelaksanaan kebijakan tersebut dilakukan oleh Kementerian Perhubungan dan PT Kereta Api Indonesia (Persero) pada tahun anggaran 2024, serta sejauh mana efektivitasnya ditinjau dari segi yuridis dan praktik operasional. Metode penelitian yang dipergunakan ialah pendekatan yuridis normatif serta empiris, dengan data diperoleh melalui studi kepustakaan dan wawancara. Hasil penelitian memperlihatkan jika dalam praktiknya, pelaksanaan perawatan dan pengoperasian prasarana tidak sepenuhnya mengikuti mekanisme pelelangan umum sebagaimana diatur dalam Perpres No. 16 Tahun 2018 jo. Perpres No. 46 Tahun 2025 tentang Pengadaan Barang dan Jasa Pemerintah. Sebaliknya, mekanisme penugasan langsung kepada BUMN, yakni PT KAI, lebih dominan, meskipun secara hukum diperbolehkan dalam keadaan tertentu. Kajian ini juga menemukan kesenjangan antara norma hukum (das sollen) dan kenyataan di lapangan (das sein), khususnya dalam aspek transparansi dan akuntabilitas pengelolaan anggaran negara. Oleh sebab itu, penulis merekomendasikan perlunya harmonisasi peraturan serta penguatan pengawasan serta evaluasi atas penugasan yang diberikan kepada BUMN. / This study examines the implementation of Presidential Regulation Number 33 of 2024 related to the maintenance and operation of state-owned railway infrastructure. This policy is a revision of Presidential Decree No. 53 of 2012 which previously regulated public service obligations and the management of state-owned goods in the railway sector. The main focus in this study is how the implementation of the policy is carried out by the Ministry of Transportation and PT Kereta Api Indonesia (Persero) in the 2024 fiscal year, and the extent to which its effectiveness is reviewed in terms of legal and operational practices. The research methods used are normative and empirical juridical approaches, with data obtained through literature studies and interviews. The research results show that in practice, the implementation of maintenance and infrastructure operation does not fully follow the general auction mechanism as regulated in Presidential Decree No. 16 Year 2018 jo. Presidential Decree No. 46 Year 2025 concerning the Procurement of Government Goods and Services. On the other hand, the mechanism of direct assignment to BUMN, namely PT KAI, is more dominant, although it is legally allowed under certain circumstances. This study also found a gap between legal norms (das sollen) and reality in the field (das sein), especially in the aspect of transparency and accountability of state budget management. Therefore, the author recommends the need for harmonization of regulations as well as strengthening supervision and evaluation of assignments given to BUMN.
