Abstract

Indonesia sebagai negara kepulauan memiliki ragam budaya serta kreativitas yang menjadikan hal tersebut menjadi salah satu sumber pendapatan bagi masyarakat Indonesia. Sumber pendapatan tersebut erat kaitannya bagi sektor ekonomi kreatif terutama para pelaku UMKM. Dalam prakteknya, pelaku UMKM di sektor ekonomi kreatif ini belum memaksimalkan perlindungan terhadap Kekayaan Intelektual produknya baik dalam bentuk barang dan jasa. Salah satu bentuk perlindungan KI bagi pelaku UMKM adalah dengan mendaftarkan merek produk barang dan jasa. Dengan didaftarkannya produk barang dan jasa tersebut, akan memberikan kepastian hukum bagi para pelaku ekonomi kreatif ini serta untuk memberikan perlindungan hukum dan manfaat ekonomi di kemudian hari. Berdasarakan pada Undang-undang (UU) Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis, diatur mengenai prosedur pendaftaran merek serta batas�batas yang ditetapkan. Selanjutnya dalam (UU) Nomor 20 Tahun 2008 tentang Usaha Mikro, Kecil, dan Menengah.juga diatur pasal bagi para pelaku UMKM dalam mendaftarkan Kekayaan Intelektualnya. / Indonesia, as an archipelagic country, boasts a rich diversity of cultures and creative expressions, which serve as vital sources of income for its people. This income is closely tied to the creative economy sector, particularly for micro, small, and medium enterprises (MSMEs). However, many MSMEs in this sector have not fully optimized the protection of their intellectual property (IP) products, whether in the form of goods or services. One effective way for MSMEs to protect their IP is by registering their brands for goods and services. This registration provides legal certainty for creative economy actors and ensures legal protection and potential economic benefits in the future. According to Law Number 20 of 2016 concerning Trademarks and Geographical Indications, the procedures for registering trademarks and their limitations are clearly outlined. Additionally, Law Number 20 of 2008 concerning Micro, Small, and Medium Enterprises includes provisions for MSMEs regarding the registration of their intellectual property.
