Abstract
Penelitian ini mengkaji tentang optimalisasi mediasi berbasis akta perdamaian yang dibuat oleh notaris dalam menyelesaikan sengketa perdata. Masalah pokok yang dikaji adalah efektivitas akta perdamaian yang dibuat oleh notaris dalam mengoptimalkan proses mediasi. Metode penelitian yang digunakan adalah yuridis normatif dengan dukungan yuridis empiris. Pengumpulan data dalam penelitian ini merupakan gabungan antara data kualitatif dan data kuantitatif atau dikenal dengan istilah penelitian campuran. Karena dengan menggunakan metode campuran akan memberikan gambaran yang lebih komprehensif tentang optimalisasi mediasi berbasis akta perdamaian yang dibuat oleh notaris dalam menyelesaikan sengketa perdata. Hasil penelitian menunjukkan bahwa mediasi berbasis akta perdamaian yang dibuat dihadapan notaris memiliki potensi yang besar untuk mengoptimalkan penyelesaian perkara secara damai, mempercepat penyelesaian perkara secara efisien dan mempunyai kekuatan hukum. Akta perdamaian yang dibuat dihadapan notaris mempunyai kekuatan hukum yang kuat sebagai akta otentik. Peran notaris sebagai pihak yang netral dapat meningkatkan kepercayaan para pihak terhadap proses mediasi. Akan tetapi, terdapat beberapa kendala dalam pelaksanaannya, antara lain terbatasnya kewenangan notaris dalam melakukan mediasi dan kurangnya kesadaran masyarakat. Penelitian ini memberikan dukungan regulasi lebih lanjut mengenai tata cara mediasi berdasarkan akta perdamaian yang dibuat di hadapan notaris (penguatan regulasi) serta peningkatan sosialisasi kepada masyarakat, untuk mengoptimalkan pemanfaatan mediasi, pelatihan khusus bagi notaris untuk meningkatkan kompetensi notaris dalam mediasi, serta perlunya peningkatan sarana prasarana untuk mendukung optimalisasi mediasi berdasarkan akta perdamaian yang dibuat di hadapan notaris. / This research examines the optimization of mediation based on a peace deed made by a notary in completing civil settlements. The main problem studied is the effectiveness of the peace deed made by a notary in optimizing the mediation process. The research method used is normative juridical with empirical juridical support. Data collection in this research is a combination of qualitative data and quantitative data, or known a smixed research. Because using a mixed method will provide a more comprehensive picture of optimizing mediation based on a peace deed made by a notary in resolving civil disputes. Research shows that mediation based on a peace deed made before a notary has great potential to optimize peaceful resolution of cases, speed up there solution of cases efficiently and has legal force. A peace deed made before a notary has strong legal force as an authentic deed.The role of the notary as a neutral party can increase the parties' trust in the mediation process. However, there are several obstacles in its implementation, including the limited authority of notaries in mediating and a lack of public awareness. The research provides further regulatory assistance regarding mediation procedures based ona peace deed made before a notary(strengthening regulations) as wel las increasing out reach to the community, to optimize the use of mediation, special training for notaries to increase notary competencein mediation, as well as the need to improve infrastructure to support Optimization of mediation based on a peace deed made before a notary.
