Abstract

The law is the most important part in social life because as we know in every society there must always be a law that regulates. Law enforcement to prevent crime is important because crime is damaging public safety and happiness. This study discusses the non prison santions taken against criminal offenses reviewed through the criminological perspective of Cesare Beccaria that the right to punish is state property and Sutherland's thought in the differential association theory states that the emergence of crime occurs through social interaction. This study reviews through cases of sexual harassment experienced by UGM students in 2017, sexual abuse experienced by a child in the Jakarta KRL in 2019 and the decision of Purwokerto Court Number 246/Pid.B/2009/PN.PWT. This study uses a sociological legal research method which is a legal research method that functions to see the law in the real sense and examine how law works in the community. The conclusion of this study is that non prison santions to crime has been realized in the RKUHP and non prison santions is needed because the fact that the application of imprisonment does not change the convict for the better, plus the fact that prisons in Indonesia are entering extreme overcrowding situations. One of the strategy to overcome these problems is by efforts to form and develop non-prison sanctions and the concept of restorative justice.
