Abstract

Buying and selling land under the hand is a legal act of transfer of land rights between the seller and the buyer that is not done in front of PPAT. In accordance with current legal regulations, namely Government Regulation No. 24 of 1997 concerning Land Registration that, the transfer of land rights carried out through the sale and purchase can only be registered if proven by a deed made by the PPAT. The purpose of this research is to know the validity of buying and selling of land under the hands and legal protection for the seller and buyer in Decision Number 29/Pdt.G/2014/PN. Cirebon. This research uses normative research using secondary data, how to obtain data from the literature study, using a type of approach to the law and cases, then analyzed qualitatively. Sale and purchase of land that occurred on July 26, 1995, between the late. Nani Sukini and late. Mrs. Soemiyoto carried out under the hand with proof of payment in the form of a receipt is legal because it has met the material requirements. The material requirements are late. Mrs. Soemiyoto has the authority and the right to sell the land and building as recorded in the Certificate of Ownership No.563 Sunyaragi Environment is in the name of the deceased. Soemiyoto (deceased husband Mrs. Soemiyoto), late. Nani Sukini, as the buyer, has fulfilled the conditions of the holder of the right of ownership, namely Indonesian citizens, and the land and buildings which are the objects of sale and purchase are not in dispute. The existence of Decision Number 29/Pdt.G/2014/PN.Cirebon which has permanent legal force stating that the sale and purchase are legal, then the process can be renamed to the Land Office. This provides legal protection for the parties by issuing certificates in the name of the heirs of the late. Nani Sukini as a form of proof of legal ownership of the land and buildings on it. In conclusion, buying and selling land is done underhanded between the late. Nani Sukini and late. Mrs. Soemiyoto is legal, and the Decision Number 29/Pdt.G/2014/PN.Cirebon which has legal strength has been providing legal protection for the parties so that the process can be carried out behind the name of the Land Office.
