Pelanggaran hak cipta terjadi ketika seseorang menggunakan ciptaan orang lain tanpa izin pencipta atau pemegang hak cipta, yang diantaranya penggandaan/penyalinan film tanpa izin seperti pembajakan, mengupload film ke situs streaming tanpa izin, serta mempublikasi atau menyebarluas film tanpa izin. Meskipun adanya ketentuan hukum yang melarang pembajakan, nyatanya pembajakan masih marak terjadi di Indonesia. Indonesia sendiri termasuk kategori negara permintaan tertinggi pada produk bajakan. Salah satu contoh kasus pembajakan film di Indonesia seperti film Keluarga Cemara. Rumusan masalah dalam penelitian ini adalah bagaimana penegakan hukum hak cipta terhadap pembajakan film di Indonesia dan bagaimana pertimbangan hakim di Pengadilan Negeri dalam penegakan hak cipta terhadap pembajakan film berdasarkan studi Putusan Nomor 762/Pid.Sus/2020/PN-Jmb. Metode penelitian yang digunakan adalah penelitian hukum normatif yang menggunakan bahan hukum primer data sekunder. Undang-Undang Hak Cipta Nomor 28 Tahun 2014, Undang-Undang Informasi dan Transaksi Elektronik Nomor 19 Tahun 2016 tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008, Peraturan Pemerintah Nomor 71 Tahun 2019 tentang Penyelenggaraan Sistem dan Transaksi Elektronik yang menjadi landasan perlindungan hukum. Mekasime penegakan hukum dilakukan secara litigasi, non litigasi, dan kewenangan lembaga. Pada kasus film Keluarga Cemara, terdakwa dikenakan Pasal 113 ayat (3) UU Hak Cipta karena kerugian ekonomi yang ditimbulkan atas tindakan pelanggaran hak cipta harus dapat dipertanggung jawabkan pelaku. Saran penulis untuk menindak pelanggaran hak cipta bukan dari pelaku saja, namun pemerintah perlu sosialisasikan kepada masyarakat pentingnya karya cipta bagi pencipta untuk tidak mengakses situs ilegal. / Copyright infringement occurs when someone uses someone else's work without the permission of the creator or copyright holder, which includes unauthorized duplication/copying of films such as piracy, uploading films to streaming sites without permission, and publishing or distributing films without permission. Despite the existence of legal provisions prohibiting piracy, in fact piracy is still rampant in Indonesia. Indonesia itself is categorized as the country with the highest demand for pirated products. One example of a movie piracy case in Indonesia is the movie Keluarga Cemara. The formulation of the problem in this study is how the enforcement of copyright infringement against film piracy in Indonesia and how the consideration of the Constitutional Court in the enforcement of copyright against film piracy based on the study of Decision Number 762/Pid.Sus/2020/PN-Jmb. The research method used is normative legal research using primary legal materials secondary data. Copyright Law Number 28 of 2014, Electronic Information and Transactions Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008, Government Regulation Number 71 of 2019 concerning the Implementation of Electronic Systems and Transactions which is the basis for legal protection. The mecasime of law enforcement is carried out by litigation, non-litigation, and institutional authority. In the case of Keluarga Cemara movie, the defendant is subject to Article 113 paragraph (3) of the Copyright Act because the economic losses incurred by the act of copyright infringement must be accountable to the perpetrator. The author's suggestion to crack down on copyright infringement is not from the perpetrator alone, but the government needs to socialize to the public the importance of copyrighted works for creators not to access illegal sites.
