According to Article 1 Point 16 Government Regulation of the Republic of Indonesia Number 28/2004 concerning Food Safety, Quality, and Nutrition, food home industry shall mean any food company that uses its residence as a business venue with manual up to semi-automatic food processing equipment. Anybody including home industry who producing packaged food including snack into the territory of Indonesia for trading shall put labels on in and or as part of food packages. The labels shall contain information which at least have expired date. However, researcher found some food home industry who producing packaged snack without expired date in Tangerang City. This research aims to determine legal protection for consumers against home industry’s packaged snack products without expired date in Tangerang City and the effort to minimize the sale of expired snack in Tangerang City. The research used normative-empirical research method. In this research, the data were collected from literature studies and interviews, then the data were analyzed qualitatively. The research results showed that information of expired date is a consumer right that must be fulfilled by the food home industry. Some of the home industries haven’t received any development or any control from The National Agency of Drug and Food Control based on Serang and District Health Office of Tangerang City. This can be concluded The National Agency of Drug and Food Control based on Serang and District Health Office of Tangerang City haven’t done their job well yet.
