Abstract

Legal protection for revenge porn cases in Indonesia is very weak, there is no article in the Pornography Law that protects people who are forced and told to make pornographic content. This research aims to know the protection of victims of non-consensual pornography (revenge porn) in terms of Law No. 44 of 2008 concerning Pornography Law No. 31 of 2014 concerning Witness and Victim Protection, and Law No. 19 of 2016 concerning Electronic Information and Technology and the implementation of punishment for non-consensual pornography (revenge porn) perpetrators, Decision Study No. 1288/Pid.Sus/2017/PN BJM. This research is a normative-empirical research. Data used in this research are primary and secondary data. Data collection technique used are field research and library research. The approach used is approach to legal synchronization and case study. Data analysis method used is juridical-qualitative by induction. The research results showed that Indonesian legal structure based on the Criminal Code Procedure still committed victimization and has not provided victim protection, there is no Indonesian legal substance (Law concerning Electronic Information and Technology, Law concerning Pornography, and Law concerning Witness & Victim) that protected the interests of victims and provided full protection for victims of revenge porn, and community acceptance of the protection of victims of revenge porn in Indonesia is still very low. In deciding a case No. 1288/Pid.Sus/2017/PN BJM, Panel of Judges used Law concerning Electronic Information and Technology Article 45 regarding to Article 47 verse 1 and decided that the Defendant has fulfilled the exist elements therefore should be found guilty. The Panel of Judges considered the Defendant’s polite attitude and compassion that the Defendant gave as ease circumstances. This consideration should not be included because the Panel of Judges as legal structure can be an example for the community and as a form of decency crime prevention.
