Abstract

Tanda tangan elektronik merupakan salah satu perkembangan dan pemanfaatan teknologi yang semakin terus berkembang dan digunakan di banyak produk pemerintah yang dulunya menggunakan tanda tangan bersifat konvensional. Tesis ini menganalisis mengenai penggunaan tanda tangan elektronik oleh Notaris pada Salinan Akta dan dalam melaksanakan kewenangannya lainnya ditinjau dari Undang-Undang Nomor 2 Tahun 2014 tentang Perubahan Atas Undang-Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris (UUJN) yang dihubungkan dengan Undang-Undang Nomor 19 Tahun 2016 tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik (UU ITE). Metode pengumpulan data dilakukan dengan studi kepustakaan. Hasil penelitian ini menunjukkan bahwa penggunaan tanda tangan elektronik pada Salinan Akta tidak diatur dan tidak ada larangan dalam UUJN. UUJN hanya menyebutkan penandatanganan dilakukan setelah pembacaan akta yang merupakan tata cara pembuatan minuta akta sehingga penggunaan tanda tangan elektronik pada Salinan Akta dan dalam pelaksanaan kewenangan Notaris lainnya dimungkinkan untuk dilakukan karena tanda tangan elektronik telah memiliki kekuatan hukum dan sebagai alat bukti yang sah. / Electronic signature is one of continuously growing technology developments and utilizations and being used in many government’s products which previously using conventional signatures. This thesis analyzes the use of an electronic signature by Notary in Official duplicate copy of the deed as well as in carrying out other Notary’s authorities in view of Law No. 2 of 2014 regarding amendment of Law No. 30 of 2004 regarding Notary’s Function, being associated with Law No. 19 of 2016 regarding amendment of Law No. 11 of 2008 regarding Information and Electronic Transactions. The data is collected by using library research method. The result of this research reveals that the use of electronic signature in copy of a deed is not regulated and prohibited by Notary’s Function Law. The Notary’s Function Law only states that the execution is carried out after recitation of the deed which is the procedure in drafting a deed, therefore the use of electronic signature in copy of a deed and in carrying out other authorities by Notary is possible to do since the electronic signature itself has legal power and is regarded as valid evidence.
