Abstract

This research aims to study and analyze IVF pregnancy programs from a Christian perspective and settlement of disputes between doctor and patients about the results of the IVF Pregnancy Program based on District Court Decision Number 325/Pdt.G/2017/PN.Sby that doesn’t have permanent legal force, seen from the perspective of Indonesian civil law. This research is a normative study. Uses the statutory regulations related to the case that the writer adopts based on Surabaya District Court Decree Number 325/Pdt.G/2017/PN.Sby which does not have permanent legal force. Related to the topic, many Christians consider IVF to be an act that goes beyond God's will. But besides that, technological development is needed to fulfill human life at the present time. Supported by regulations regarding agreements between doctors and patients (therapeutic agreements) which are still not widely understood by most patients. Causing disputes between doctors and patients. As in the case raised by the author, that is based on the Surabaya District Court Decision Number 325/Pdt.G/2017/PN.Sby who do not have permanent legal force. From this decision, doctors are sued for defaults on IVF agreements with patients. But the judges can’t prove that the doctor has defaulted because there is no evidence that the doctor promises results or violates his promises. So rather than that, disputes relating to therapeutic agreements must be reviewed from civil law.
