Abstract

Not only the development of technology and communication in the Internet has induced positive impacts, but also negative impacts as well. The positive impacts from the development of information and technology facilitate society to obtain more information from inside and outside of their country regarding the progresses happening and changes of lifestyle that are getting even more practical. The negative impacts that exist are the cause of the absence of any boundary, which has resulted people to act arbitrarily in using these tools of communication to violate the law, such as piracy, pornography, contempt or defamation. The method used in writing this essay is through normative legal research methods by using an approach towards the law, by the means of literature, papers, and legislations related to this research, and an analysis produced in a form of writing. The filing of a claim for compensation caused by contempt or defamation in social networks could be based on the law no.11 of 2008 on Information and Electronic Transactions as a legal basis in a lawsuit, especially in article 27 verse (3), which manages prohibited actions. Regulation of civil law is regulated in verse 1365 and compensation for defamation is regulated in verse 1372 criminal law
