Rapid technological development often exceeds the applicable legal rules. These days, online trading as one of the most often form of trading has several issues regarding consumer’s loss caused by online trade. Online transaction which is an improvement of buy-and-sell transaction, is an agreement which bind both party, but using the internet as it’s main tools and done without any direct interaction. So, electronic transaction has that gap which can cause disadvantage to the consumer. The regulation regarding consumer protection on electronic trading has been evolved since last decade, yet consumer still at risk of loss. Therefore Law of the Republic of Indonesia No. 11 of 1999 on Consumer Protection was made with a considerations that bussiness should evolve without causing any disadvantage to the consumers. This research intended to determine how the Law of Consumer Protection works on protecting consumer of an online trading from risk of loss, and also know the legal remedies that can be taken if a loss was happened. The method and types of this research uses juridical normative research by using the Law of the Republic of Indonesia No. 11 of 1999 on Consumer Protection and Law of the Republic of Indonesia No. 11 of 2008 on Information and Electronic Transaction, and Implementing Regulations regarding the consumer protection on online trading. The outcome of this research is that the Law of Consumer Protection not only protects the consuemer but also becomes a reference for third parties to set their own policies in order to implement the consumer protection, also Law of Consumer Protection accommodate several legal remedies that can be taken by consumer to demand fulfillment of their rights.
