Tort law is every act of inflicting harm on others, requires that a person who is guilty of causing losses to compensate for the loss. Tort law is regulated in section 1365 KUH-Perdata In the land dispute case based on decision number 26/Pdt.G/2014/PN.SBG, Defendant III controlled the land of the Plaintiffs without a legal basis, so that the act was included in an illegal act. This study aims to determine the elements of Tort Law contained in the Dispute of Land Tenure without Rights in case Number 26/Pdt.G/2014/PN-SBG and also to find out the mechanism of the correct Land Registration process according to Government Regulation Number 24 of 1997 regarding Land Registration so that land grabbing in this case does not occur again. This research is a normative legal research method that is research conducted to collect and analyze secondary data. using data collection techniques through library research in the form of a Supreme Court ruling that is analyzed using various library sources, namely books, opinions of experts, journals, websites. Then analyzed qualitatively. Qualitative normative juridical research is a research that refers to legal norms contained in legislation and court decisions and norms that live and develop in the community, are expected to produce conclusions that are in accordance with the problems and objectives of the research results. In its decision the Panel of Judges won The Plaintiffs. Then the losing party, Defendant III must surrender the land that was the object of the dispute voluntarily to the Plaintiffs. Based on the results of the analysis associated with the judges consideration, the actions of the Defendant III have indeed fulfilled the elements of Tort Law and the land registration mechanism carried out by Defendant III has not been in accordance with the Government Regulation Number 24 of 1997.
