Competition is a common and normal feature of business activities in Indonesia and most of other countries in the world. Competition itself is regulated in a separate law system. However, this thesis is attempting to discuss on how unhealthy and unfair competition in terms of “piggyback” of famous brand is undertaken by one business entity to gain unfair benefit of brand awareness using a brand name which belong to other company. When an establishment of individual or business entity start to drop in a manner against law, his opponents and action do be categorized as unfair competition. At first the brand only in regard to the goods, recognition for a brand new service on the Paris Convention. Nowdays brand isn’t only a sign but a life style. The system practised in Act No. 15 of 2001 about the brand is constitutive system, namely that the rights to the brand arising from registration. Implementation and the influx of foreign elements which are contained in the Paris Convention, more or less influenced the policy of brand protection system contained in Act No. 15 of 2001, so it's about how the effectiveness of the provisions of Act No. 15 of 2001 in reducing the unfair competition.
