Abstract

Pembangunan ekonomi, sebagai bagian dari pembangunan nasional, merupakan salah satu upaya mewujudkan kesejahteraan rakyat yang adil dan makmur berdasarkan Pancasila dan Undang-Undang Dasar 1945. Kegiatan pembangunan membutuhkan penyertaan modal yang cukup besar, karena merupakan salah satu faktor penentu dalam pelaksanaan pembangunan. Sektor perbankan yang memiliki posisi strategis sebagai lembaga yang membantu dalam memberikan penyertaan modal yang diperlukan dalam perkembangan ekonomi. Perbankan dalam memberikan kredit harus senantiasa menerapkan prinsip kehati-hatian untuk mencegah risiko yang dapat timbul akibat terjadinya kredit macet. Dengan prinsip kehati-hatian, tidak menutup kemungkinan bahwa kredit macet dapat terjadi akibat berbagai faktor eksternal yang tidak dapat diperkirakan sebelumnya, oleh karena itu langkah ideal yang bisa ditempuh bank adalah melakukan negosiasi ulang. Negosiasi ulang atau restrukturisasi merupakan upaya perbaikan yang dilakukan bank dalam kegiatan perkreditan terhadap debitor yang mengalami kesulitan untuk memenuhi kewajibannya dengan cara penjadwalan kembali, persyaratan kembali ataupun penataan kembali. Restrukturisasi diharapkan debitor mampu untuk memenuhi kewajibannya. Akan tetapi apabila debitor tetap tidak mampu memenuhi kewajibannya maka akan dilakukan eksekusi atas agunan yang diberikan oleh debitor terutama agunan solid yaitu tanah yang nilainya cenderung akan terus meningkat. Eksekusi atas agunan tanah yang diikat dengan hak tanggungan tersebut dilakukan melalui suatu lembaga independen yang disebut sebagai Kantor Pelayanan Kekayaan Negara dan Lelang (KPKNL). Akan tetapi dalam praktiknya pelaksanaan eksekusi jaminan debitor melalui lelang tidak semudah sebagaimana dicita-citakan dalam Undang-Undang Hak Tangunggan. Pihak bank seringkali kurang memperhatikan prinsip kehati-hatian dalam melaksanakan eksekusi yang menyebabkan adanya kerugian debitor, sehingga menyebabkan adanya gugatan atas eksekusi yang dilakukan bank. Hal ini dapat mempengaruhi pihak pemenang lelang karena tidak adanya perlindungan hukum bagi pemenang lelang yang telah sah memberi tanah hasil eksekusi tersebut. / Economic development, as part of national development, is one of the efforts to reach prosperous people’s welfare based on Pancasila and the 1945 Constitution. Development activities require substantial capital participation, because it is one of the determining factors in the implementation of development. The banking sector has a strategic position as an institution that helps in providing the capital investment needed in economic development. Banks in providing credit must apply the precautionary principle to prevent risks that can arise from the occurrence of bad credit. Even with the precautionary principle, the possibility of a bad loans can still occur due to various external factors that cannot be predicted in advance, therefore the ideal step that bank can take is to renegosiate the contract. The renegotiation or restructuring is an effort to repair the contract conducted by banks in lending activities to debtor who experience difficulties to fulfill their obligations by rescheduling, re-arrangement or re-structuring. It is hoped that the restructuring will enable debtors to fulfill their obligations. However, if the debtor still unable to fulfill his obligations, then the collateral given by the debtor will be carried out, especially solid collateral, namely land whose value tends to increasing. Execution of land collateral tied to the mortgage is carried out through an independent institution called the Kantor Pelayanan Kekayaan Negara dan Lelang (KPKNL). However, in practice the implementation of the debtor's guarantee execution from auction, is not as easy as it is envisioned in the Act. The bank often pays little attention to the principle of prudence in carrying out executions that cause debtor suffer loss, thereby causing a lawsuit over executions carried out by banks. This can affect the winning bidder because there is no legal protection for the winning bidder who has legally granted the result of the execution.
