Indonesia is a nation that is growing and striving to reach the point of welfare and in this case can also be seen that the Government is also contributing in various development actions by issuing a variety of legislation. A legal product that produced is not authoritarian , but implementatif , realistic and containing the values of justice and ethics national and state. Relating to development policy the national law, then lawmakers must be able to formulate a form of proper legal rules. But in reality, is still a lot of the rule of law that was not clear that led to the law there's a gap that can be abused. Licensing it is very attached to any development which is often abused. One of them is on regulation of law relating to licensing of boarding houses. Many parties who are interested in making boarding houses business due to a sizable income with only with living room for rent, easy home business like this makes many people ignore the requirements that must be met in establishing boarding houses. Therefore, the purpose of this legal research is to analyze on regulation of law and due to the law of abuse over the function of building permit house residence to boarding houses in Indonesia, by using the statute approach and historical approach. Based on that purpose, writer urged the central government to make a special act licensing about the permit of boarding houses in Indonesia.
