Abstract

Land Deed Official is a position regulated in Government Regulation No. 37 of 1998 concerning the Position of Land Deed Officials, where in Article 2 the Government Regulation regulates the main duties and authority of Land Deed Officials (PPAT), which in line The main task and authority of the Land Deed Authorities is to carry out part of the land registration requirement by making a deed as proof of certain legal actions regarding land rights or ownership rights over a unit of flats, where the deed will be the basis for changes in land registration data. caused by that legal action. According to article 5 letter (a) Government Regulation No.37 of 1998 regulates that in regions which do not have enough PPAT, the Camat can act as a Temporary PPAT. The Camat in his position also has the duty to record land ownership in his work area in Letter C or the Land Book. Ida Yulidina as the Plaintiff in this case filed a lawsuit against the Ministry of Industry, BPN Bandung, Coblong District, and Dago Village because they felt the Ministry of Industry had done Acts Against the Law by occupying its land, the rights held by Ida Yulidina were the Deed of Sale and Purchase which was made by Coblong District which is actually not owned by the seller. On the other hand, the Ministry of Industry has a Right of Use Certificate with a clear history, based on that Bandung District Court Judge won the Defendant as stated in Decision No.126 / Pdt.G / 2015 / PN.Bdg. Ida Yulidina filed an appeal, which ended with a decision that upheld the previous decision as stated in Decision No.205 / Pdt / 2016 / PT.Bdg. The purpose of this study is to analyze the resolution of the law and find out the legal considerations and judges' decisions in this case using the normative juridical method and the approach to legislation, cases, and conceptual. The results of this research are the Government Regulation on Land Registration and the Official Position of the Actor of Land Deed Making that has been carried out in this case, the Panel of Judges at the first level and the appeal has also provided legal certainty in accordance with the Government Regulation regarding Land Registration which states that the Certificate is proof of ownership the most powerful land by winning the Defendant's party.
