Indonesia is a country that has a lot of natural resources, both rich in renewable resources and also non-renewable resources. One of Indonesia’s famous non-renewable resources is the mineral resource. At this present time, the mining activities in Indonesia are growing; especially the coal mining activity is growing rapidly, particularly in the area of South Kalimantan where the area has rich coal resources. But the fact is, although Indonesia has rich natural resources, those resources are not managed wee enough for the benefit of the Indonesian people, as mandated by the Indonesian Constitution Year 1945 (“UndangUndang Dasar 1945”), Article 33 paragraph (3), where insisted that Indonesia's natural resources are controlled by the state and will be used for the overall prosperity of the Indonesian people. To implement the constitutional mandate, the government issued Law No. 4 Year 2009 on Mineral and Coal in lieu of Law No. 11 Year 1967 on Basic Provisions of Mining. Law No. 4 of 2009 and the decision of the constitutional court No. 10/PUU-X/2012 have given further legal arrangements regarding mining in Indonesia. Considering there are several different things compared to Law No. 11 Year 1967, this research is needed to explain the changes that occurred in the mining activities in Indonesia so that there is clarity regarding the management and operation of coal mining in Indonesia, especially in Tapin South Kalimantan
