Construction workers face a great risk of accidents and disease while working. Based on Article 4 Paragraph (1) Minister of Public Works Regulation Number 05 / PRT / M / 2014 concerning Guidelines for the Occupational Safety and Health Management System (OSHMS) in the Field of Public Works that OSHMS must be applied in the field of public construction. OSHMS construciton works is part of the company’s management system to control the risk of accidents and diseases and to create safe, efficient and productive work. The purpose of this research is to understand the implementation of legal protection of construction workers at development of Montana Cluster in Cikupa and understand the responsibilities of the central government and regional government if legal protection for construction workers regarding OSHMS construction works at development of Montana Cluster in Cikupa not implemented. This research is using a normative legal research method with a legislation approach, uses secondary and primary legal materials from library study, interviews and questionnaires then the materials were analyzed qualitatively. Based on materials obtained, the regulations already regulate the obligation of the construction service provider to apply OSHMS contruction works in every construction activitiy. Based on primary materials that OSHMS construction works has not been applied to Montana Cluster in Cikupa development activities by PT. Karya Cipta Bangun Mandiri and the role of the central government and regional government has not been seen in the implementation of relevant regulations. In conclusion, legal protection for construction workers regarding OSHMS construction works still formally by legislation but has not been implemented materially.
