Abstract

The making of the MoU is an initial agreement between legal subjects that agreed or understood to make an agreement. In the land buying process as stipulated in the MoU problems often occur in the land buying implementation due to a party that commited a default. As the case in the Supreme Court Decision number 1217K/PDT/2015. This essay discussed two problems namely the legal power of MoU in the land buying based on the Legal Agreement in Indonesia and the legal repercussion of default to the MoU in land buying (Case Study of Supreme Court Decision number 1217K/PDT/2015). This research used normative juridical method with Laws and Cases approach. The research’s results showed that legal power of MoU in the land buying cannot be used as a basis for the transfer of land rights because MoU is conducted through the underhand making by the parties. MoU in the land buying can be said to have binding power to the parties like an agreement if the substance has met the Article 1320 and 1338 of Civil Code. The legal repercussion to the MoU in the land buying at the case study of Supreme Court Decision number 1217K/PDT/2015 the defendants must pay the remaining price of Land Buying of Plantiff’s Property and interest with the total of Rp 525.000.000,- (Five Hundred Twenty Five Million Rupiah). Instead the Plaintiff has the right to receive compensation.
