Abstract
Land is an important requirement for human life. One of the important roles of land in human life is as a place to establish a development infrastructure that is useful for humans. With so much development in Indonesia, especially in urban areas, of course regulations regarding land use must be regulated in legislation to ensure legal certainty over land rights. Solid surface soil causes the use of underground space to be an alternative for the Government in utilizing the use of underground space as a solution to the problem of land limitations that only limit the earth's surface, but do not cover the basement. The use of underground space in the Jakarta-Bandung Fast Train Development requires the person responsible for implementing and procuring the Jakarta-Bandung Speed Train infrastructure, in this case a permit from the governor through the governor's regulation is needed. In order to utilize the basement, it is necessary to have a registration procedure for the basement which regulates the Right to Use Above and Basement to guarantee legal certainty. However, when looking at it from a legal perspective, there are problems with the use of basements, namely the absence of legislation that clearly regulates the use of basements, which causes a legal vacuum. This Final Project explains the use of the basement to the Jakarta-Bandung Fast Train Development, the use of the basement, and the registration of the basement. The results of this study are that the use of the basement and registration of the basement shows that there is a legal vacuum in the use rights of the basement which causes the guarantee of legal certainty of the basement cannot be realized clearly. If the Draft Land Law has been formally passed, then the guarantee of legal certainty over the right to use the basement can be realized clearly.
