Abstract

Forest was given by Lord Jesus to be guarded and to be used wisely for humanity. Forest is one of natural resources that a country have. In Indonesia, there is a rule in UUD 1945, where country have a responsibility to used natural resources in a purpose for the good of Indonesian people. But some people in Indonesia like to exploite the forest for their own benefits, even though they know the rules. This people exploite the forest in Indonesia in many ways, like doing illegal logging and burn the forest. Because of this exploitation, pollution and destruction of the environment happens and cause detrimental to the country and surroundings. PT. Merbau is one of the business entity in Indonesia that do illegal logging, and cause pollution and destruction towards the environment. The pollution and destruction measures need to be regulated by law. The pollution and destruction of the environment must be accounted for. It is called a tort and regulated in Article 1365 Civil Code. The author’s main purpose on writing this essay is to raise pollution and destruction of the environment issue caused by illegal logging, because the damage of the forest in Indonesia is getting worse and harm the surroundings. In conclusion, pollution and destruction towards the environment is an activity that is prohibited by law. Which is regulated in Law No. 32 of 2009 about environment law. And pollution and destruction towards the forest is also prohibited by law. Which is regulated in Law No. 18 of 2013 about forest law.
