Abstract

pemberian hak tanggungan tidak sepenuhnya membuat kreditor aman, karena dalam UUHT dijelaskan hal-hal yang dapat membuat hapusnya hak tanggungan. Salah atunnya adalah dengan hapusnya hak atas tanah. Salah satu penyebab hapusnya hak atas tanah adalah dengan penetapan tanah terlantar. Pokok permasalahan mengenai: Bagaimanakah Proses Penetapan Tanah Terlantar Oleh Badan Pertanahan Nasional Republik Indonesia? Upaya-Upaya apa yang dapat dilakukan kreditor pemegang hak tanggungan untuk mencegah hapusnya hak tanggungan karena hapusnya hak atas tanah objek hak tanggungan karena penetapan tanah terlantar?. Jenis penelitian yang digunakan adalah tjenis penelitian hukum normatif. Sifat penelitian yang digunakan adalah penelitian hukum yang bersifat deskriptif. Data yang digunakan adalah data primer, sekunder dan tersier. Penulisan dianalisis secara kualitatif. Kesimpulan yang didapat dari penelitian ini yaitu upaya-upaya yang dapat dilakukan kreditor pemegang hak tanggungan untuk mencegah hapusnya hak tanggungan karena hapusnya hak atas tanah objek hak tanggungan karena penetapan tanah terlantar adalah Pembuatan janji-janji pada Akta Pemberian Hak Tanggungan (APHT), Permintaan jaminan tambahan kepada debitor, Menambahkan klausula Hak Untuk Mengeksekusi dalam perjanjian pokok, Melakukan komunikasi dan pemantauan terhadap debitor/A trademark become an instrument of commerce that increasingly important in the current era of global economy and making potential transaction of transferring trademarks. Article 41 paragraph (1), Law of the Republic of Indonesia Number 20 of 2016 concerning Trademark and Geographical Indication stipulate trademark transfer based on transfer agreement. In this respect, it is necessary to review the trademark transfer agreement and the role of public Notary in making the agreement based on a literature study that contains theories and related legislation. It can be concluded that the trademark could be transferred with an agreement. The trademark transfer agreement must be accompanied by a levering process, as known as written evidence such as the assignment agreement or contract parties that have been validated by public Notary. Consequently, the role of public Notary is very important, because they have to provide an explanation to the parties about the Trademark Agreement and reasons causes a revocable agreement.
