Abstract

Based on the reality, Indonesia has indigenous peoples whose communal rights still exist. However, in order to have the acknowledgment, the communal rights must fulfill the main criteria which had been determined by statute. The thesis is motivated by the existing communal land disputes problems between indigenous peoples and the company in Indonesia. Sometimes, those problems create long-drawn conflict for years. The purpose of this research is to explore and analyze the legal protection of indigenous peoples’ rights whose communal land overlap with plantation land. The importance of human relationships to the land, is not only among individuals to the ground, but also among a group of indigenous peoples in relation with their communal rights. Moreover, Indonesia recognizes and respects the law of indigenous peoples and their traditional rights which live and correspond with the state principle. It means the State should also provide protection against them. The struggle in defense of communal rights could be seen in one of the cases that occurred in Regency of Agam, West Sumatra between indigenous peoples of Tanjung Tribes and plantation companies. This research uses normative legal research with statute approach and case approach. Furthermore, this research uses also qualitative analysis to analysis the issue. The result of this research will present how the legal protection from the state towards the existing communal rights based on the statute and the case study
