Abstract

Nowadays, television broadcasting has become one of the most developing business sector in Indonesia. In the former President Soeharto government, it was difficult to establish private television broadcasting institutions. But the tides have changed at the beginning of the reformation era, where the number of private television broadcasting institutions increased, especially those broadcasting in a national scale. In order to regulate the existence and sustainability of the television broadcasting, the government established The Act Number 32 in the Year 2002 regarding Broadcasting, and The Government Ordinance Number 50 in the Year 2005. Eventually, the increasing number of private television broadcasting institutions are not followed by the main principles of private broadcasting, namely the content and ownership diversity. In fact, the number of private television broadcasting institutions spread throughout Indonesia are owned by only a group of legal law firms or individuals. This situation can also affect the broadcasting content. The basic content often neglected by the owners of the media and the Indonesian Government itself is from the Article 18 of The Act Number 32 in the Year 2002 that limits the number of private television broadcasting institutions ownership. Nevertheless, many law firms or individuals own more than one private television broadcasting institution in one province. One of the example is PT.Media Nusantara Citra Tbk, that owns three private television broadcasting institution residing in the DKI Jakarta Province. Therefore, this thesis emphasizes on the legal research of the implementation of Article 18 of The Act Number 32 in the Year 2002 regarding television broadcasting in Indonesia. The result of this research serves to give a concept regarding private television broadcasting ownership limits and the implementation in Indonesia.
