Abstract
International shipping plays a big role in international trade. However, as shipping industry flourishes, there needs to be a balanced obligation to mitigate marine environment pollution and preserve the sea. In fact, as a result of sea expeditions, the ships could often unknowingly pose a number of threats to the marine ecosystem. One of them is that the ship could potentially carry viruses or bacteria that can damage the marine ecosystem and can endanger human health. One of the conventions issued by the International Maritime Organization (IMO) is the Ballast Water Management and Sediments Convention (BWMC). The convention aims to prevent the outspread of dangerous aquatic organisms from one area to another, by setting standards and procedures for the management and control of ballast water and ship sediments. Beside examining the BWMC itself, this Thesis will also compare domestic regulations between Indonesia and Singapore. The Author takes Singapore as a benchmark for Indonesia because Singapore and Indonesia share the same sea area, both are Asian countries, and have cooperated extensively in various areas, including sea transportation. The Author identifies that Indonesia has not yet fully committed as a signatory state to the BWMC. Law enforcement regarding the BWMC in Indonesia is still lacking of attention by the Government of Indonesia. On the contrary, Singapore is very committed to this international convention. It can be said that Singapore has become a leading country in South East Asia that has demonstrated its commitment to the BWMC. Therefore, considering that Indonesia has a goal to become the Global Maritime Fulcrum in consideration of its predominant sea area (80% of its total area), it is very important for Indonesia to pay more attention to its international obligation as enshrined within international conventions to preserve the country’s most important source of resources – its maritime environment.
