Intellectual Property can be classified in two types, first is copy rights and second are industry property right. Industry property rights can be also classified into 4 type of rights first is trade secrets, patent, trade mark and industrial design. In this thesis will discuss about patent. In Patent Law No. 14 of 2001, patent are divided into two type of patent first is patent and second is simple patent. Simple patent have a difference with the patent which is like the term of simple patent protection, type of invention that can be protected by law as a simple patent. In Indonesia progress of the research still limited therefore the invention that found by the inventors is simple patent, because that matter the protection of simple patent is very important in Indonesia for the inventors that found invention. In Patent Law regulated about simple patent like the invention that can be protected as simple patent, the term of simple patent protection, the settlement of patent dispute. Related to the case that discussed in the writing is case of cancellation of simple patent belong to Tan Suryanto Jaya by Djaka Agustina. The authors tried to see the effectiveness of simple patent protection through the case of Djaka Agustina and Tan Suryanto Jaya about the cancellation of simple patent
