UUPA legislation in 24 September 1960 has changed and replaced the agrarian law and system before it, which was the agrarian law and system succeed by the Dutch colony, also known as agrarian western law. Before UUPA administered the agrarian law applied in Indonesia was agrarian western law that fundamentally are individualistic and created dualism of agrarian law in Indonesia. UUPA acted to change and unify the agrarian law in Indonesia based on the customary law. UUPA’s conversion cause stated that the eigendom land rights must be convert into the rights known by UUPA before 24 September 1980. Which after based on Keppres No. 32 Tahun 1979, for the people whom occupy or ex eigendom owner the land ex eigendom rights earned the privilege to register the right of property/land. Until then the ex eigendom land right still exist and recognize as the evidence of land ownership based on Peraturan Pemerintah No. 24 Tahun 1997. The ownership of land often give rise to conflicts and disputes especially when the dispute include eigendom land right’s. The objective of this study is to prescript the land ownership dispute over egiendom right’s in Supreme Court Decision Number K 1955/Pdt/2018, by analyzing the verdict made by Indonesia Supreme Court to determine who is the rightful owner of the property and how eigendom right’s stands as a strength of proof of land ownership. In study the writer used legal approach, case study and conceptual approach to examines theories and laws related to this case.
