Abstract

In commercial business area, activities debts is a common thing to do. In this activities is born the relationship between creditor and debtor. The relationship between creditor and debtor often have problem if the debtor is unable to pay their debts to creditor. Therefore, the debtor is unable to pay their debt then the creditor usually filed a bankruptcy petition against the debtor. In Indonesia regulations regarding bankruptcy stipulated in Law No. 37 year 2004. This thesis discusses about how to file a bankruptcy petition against the debtor as the Joint Operation. This thesis uses normative legal research using the approach of legislation and casebased approach. Currently in practice, Joint Operation is not regulated in legislation in Indonesia. Despite the fact that the practice of Joint Operation have often done in Indonesia. To avoid confusion about the Joint Operation entity required proper explanation especially about legal status and the form of Joint Operation. Therefore to find out how to file a bankruptcy petition against the Joint Operation, it must know the legal position and form of business entity Joint Operation under applicable laws in Indonesia. This thesis gives a picture to describe the form of business entity and the legal position of Joint Operation in Indonesia. Based on analysis, Joint Operation could be categorized as a Firm, considering the aspect of establishment and the body names. In terms of filling bankruptcy petition to the Joint Operation can be done by following the procedures for bankruptcy to the Firm
