Abstract
The terms passing off or unveiling a brand are unknown in the conception of Indonesian marks law, but tend to be better known in Common Law countries as part of fraudulent competition. The problems that arise are how the arrangement of passing off in providing protection on the marks and how the effectiveness of the implementation of legal protection of the brand based on the conception of passing off in Indonesia in accordance with Supreme Court Decision No. 653 K/Pdt.Sus-HKI/2014. This study uses normative legal research methods supported by primary legal materials and secondary legal materials. The results showed that the conception of the arrangement of passing off in providing marks protection in Indonesia refers to Article 6 Paragraph (1) Sub-Paragraph a of Act No. 15 of 2001 regarding Marks (Old Marks Law) and Article 83 of Law No. 20 of 2016 regarding Marks and Geographical Indications (New Marks Law). The mark's arrangement under such legal provisions is intended to provide effective protection in the prevention of all offenses and / or fraudulent deeds, including the deeds of passing off. Supreme Court Decision. 653K/Pdt.Sus-HKI/2014 which substantially rejected the appeal of MIKROSID (the appellant cassation), the IDM00027865 number, on behalf of PT. BERNOFARM is based on the principle of good faith contained in Article 4 of Law no. 15 of 2001 regarding Marks that have an understanding that the applicant who registered his mark must be based on honesty, goodwill, and without any intention to piggyback, imitate and plagiarize the fame of other‟s brand and cause the mislead in public.
