Crimes Against Humanity occurred in Buru Island in the period of 1969-1979. Unfortunately, the case has not yet been legally settled by the slate, which is contrary to the state's obligation of human rights enforcement. Based on the state responsibility that shall protect the whole people of Indonesia and the entire homeland of Indonesia , the government must make efforts to settle and be commited to redress the disadvantage that occun-ed to the former political prisoners who suffered during the exile in Buru Island. This research aims to understand the Crimes Against Humanity in Buru Island based on international law and to find out about the state's obligations to the former political prisoners. Furthermore, this research aims to analyze the competence of International Criminal Court (ICC) to settle the case legally. This research is juridical normative legal research that uses Statute Approach and Historical Approach while the object of research is primary law material, seconda1y law material, and non-law material. The analytical method that will be used is qualitative method.
