This study discusses a marriage covenant that is an agreement between husband and wife that contains on what matters that the content is up to the couple and also one of them about the separation of property. the beginning of this study due to the filing of a trial petition report reported by Ike Farida which according to him there are some articles harming Indonesian citizens who are marriage to foreign nationals and do not make a marriage agreement for reasons of ignorance of this. the judge approves and alters any of the articles deemed by the judge to be altered due to several considerations. due to a change of article by the judge then there is a difference between the old article with the new article that is intended to help solve new problems but, the consequences of the changes there are changes that must be analyzed further so that can be understood by the public as well there is a constraint that is supposed to be a reference to the occurrence of unlawful acts commited by a married couple to an agreement made by a third party prior to the marriage agreement but ultimately making a marriage agreement. this analysis will use several books and also collect existing data data to assist this research and also use interviews to one of the expert sources on this issue in order to avoid misunderstanding in this research.
