Euthanasia is an action that take away the pain by making the person who feels the pain lose their life or death. There is two type of euthanasia by the way it done, that is passive and active. In Indonesia weither passive euthanasia or active euthanasia is prohibited by the Section 344 of Criminal Acts, and Explanation of Section 11 Physician Ethics but we can see the practice of doctor withdrawing life supports from the patient. Withdrawing life support can be taught as one of the passive euthanasia action. This study is a study uses normative research through primary data, secondary data, and tertiary data. Sources of data obtained from the literatures, journals, interviews, and legislation in force. From this study we can conclude that passive euthanasia is actually happened and is not prohibited in Indonesia, this action can be done in Indonesia under the cabinet minister regulation, but not like Oregon, Belanda, and Kanada which admit that it’s allowed the action of active euthanasia by the law, and give their people who complete the criteria rights to ask their own death, Indonesia only allow the action of withdrawing life support by informed consent that signed by patient’s family, or the patient’s will which expressed before. Oregon, Belanda, and Kanada is three of many country that legalize active euthanasia. Even Oregon, Belanda, Kanada allow euthanasia, but there is criteria which have to be fulfill by the patient to purpose their request to die with dignity or euthanasia.
