ASEAN is an organization between states that located in South East Asia Region which established in 1967. One of the purpose behind ASEAN establishment is to keep a peaceful situation in the region. This commitment is required considering the potential dispute between ASEAN member states. Therefore, the Dispute Settlement Mechanism itself technically already conducted in Treaty of Amity and Cooperation (TAC), ASEAN Charter, and ASEAN ASEAN Protocol 2010 to the ASEAN Charter on Dispute Settlement.In principle, the dispute settlement in ASEAN always put forward in a peaceful way like negotiation , mediation or another peaceful way solution. In Intellectual Property field, the dispute quite often happened especially between Indonesia and Malaysia. It is already noted more that 5th times, that Indonesian culture had been claimed by Malaysia, like Batik, Reog Ponorogo, and Rasa Sayange song. Until today, it is still debatable whether it is necessary to have a special dispute settlement mechanism for ASEAN region.
