Abstract

Intellectual Property Rights or abbreviated as "HKI", the equivalent of the word commonly used for Intellectual Property Rights (IPR) is the right that arises from the results of the human brain thought that produces a product or process useful to humans, which consists of copyright, trade, geographical indication, industrial design, patent, integrated circuit layout design, trade secret, brand and plant variety protection. Researchers use normative legal research using library material to analyze cases. Type of research data using secondary data consisting of primary, secondary and tertiary legal materials. The result of this research is Merek Law has been changed several times but the problem is more complex. This is due to the increasingly advanced science and technology. With increasingly sophisticated equipment and easy to obtain, the more easily someone imitate and use more people in their business. Heavier criminal sanctions in Undang-Undang Merek 2001 Apparently not upsetting the perpetrators more crime, even still there are people who denied committed more crimes in Indonesia. In this case it is proven conclusively that Toko Rani has violated Article 91 of the Trademark Law which affirms whoever deliberately unlawfully uses the same merek in essence with another party's merchandise, is punished by 2 years in prison and or pay detention as much as Rp. 50.000.000,00 (fifty million rupiah).
