The following thesis is examines regulations of the authority of local governments in the granting of mining permits which has been regulated in Law No. 4 of 2009 of Mineral and Coal Mining and Law No. 23 of 2014 of Regional Government. This thesis uses juridical norms method as a research implementation method. The thesis will reveal and demonstrate that there is an overlapping regulation, in the law No. 4 of 2009 of minerals and coal mining stipulates that the licensing rests with the local government. whilst the regulation in the law No. 23 of 2009 of Regional government stipulates that the licensing authority rests with the central and provincial governments. Therefore this thesis describe the comparison of both advantage and disadvantage in the application between the law No. 4 of 2009 of Mineral and Coal mining and the law No. 23 of 2014 of Regional government This thesis recommends to issue a regulation to replace the older law, namely the law No. 4 of 2009 of Mineral and Coal Mining which will adjust to the newer law, namely law No. 23 of 2014 of Regional government. This thesis also recommends cooperation between central and local governments. To avoid harm either to the government or the state or to the company. This thesis examines and discuss various future developments, but ultimately recommends that.
