As we know, land is one of the most important nature resource. One of the benefits which we can get from the land is the absorption. But nowdays, as we can see the growth of the people which is not follow by the land, cause the land become something rare. And one of the people’s will is to use the land as much as they could, causing them to develop everywhere. One of the problem that the writer saw was a Governor’s provision to utilize the government’s land which is located in Kelapa Gading. The writer saw that the land, based on the Governor’s provision provide the Tiberias Church of Indonesia to use the land, and the result now the Tiberias Church of Indonesia could built a physical building in which is used to be the green area. Then the writer did this research using the statute approach and case approach and use the secondary data, which is included primary, secondary and tertiary law materials. The technique of collecting data which is used by the writer was library research, which is from reading, learning and studying literature which is relevant to the problem studied and did the interview. The conclusion that the writer can obtained are, firstly the Governor has been wrong in giving provision to the Tiberias Church of Indonesia to utilize the land because it should be used for the green area. And the second is, the physical building of Tiberias Church of Indonesia which is located in that area is based on Indonesian law, because firstly, they got the Governor’s provision to utilize the land, and before they develop the physical building, they has earned the building permit. That’s why, the Tiberias Church of Indonesia should receive the protection from Indonesian law because what they did was based on law.
