Abstract

Document Production is a legal action provided by arbitration with its’ purpose to enable the parties to establish the facts on which the party relies or contests the facts as to the other party’s case. It is a means to force the other party to produce documents in its possession which are relevant to the outcome of their dispute. In international commercial arbitration, the parties are free to agree upon the methods for document production. Document Production is still considered as “new method” to apply in arbitration. Thus the correct procedure for this method to be applied is still being questioned and its’ application is still being perceived to be unfair and not an efficient method. This research aims to find out the legal basis and how the procedure of the document production being exercised in international commercial arbitration.
