Investment is an activity that is encouraged by the state to continue to encourage the nation's economy. Indonesia has legislated regulations on investment into Law No. 25 of 2007 concerning Investment. Investments based on their sources come from domestic investors and foreign investors, where the limits of share ownership in each line of business are regulated in legislation. Limitation of share ownership in a Limited Liability Company is one of the factors for conducting share ownership through the practice of nominees. Nominees are parties whose names are borrowed and appointed to act on behalf of and for the party who appointed them (beneficiary) to carry out legal acts, one of which is as a shareholder. Nominee practice has been banned as stipulated in Article 33 paragraph (1) of Law Number 25 of 2007 concerning Investment, although it has been banned, this practice is still frequently practiced. This study aims to find out the views of Indonesian legislation on this practice through normative-empirical research methods to examine normative legal provisions and its practices in society. From the results of the study it can be proven that the practice of nominees has not been regulated in depth and the practice of nominees can be put into various types of agreements.
