Abstract

Nowadays, it can be seen that economic development from a certain state,become one of the essential aspects that can be used as an indicator to measure how advanced and well established a certain state. It is an undeniable ambition from the Association of Southeast Asian Nations (hereinafter ASEAN) state members to follow the European Union (EU) state members to realize a integration not only in the field of economy, including but not limited to politic, technology, and etc. The ASEAN ambition is the realization of an integration between the ASEAN state members, namely through the ASEAN Economic Community (hereinafter AEC). As matter of course, Indonesia as the member of the ASEAN will be facing the MEA effects and to feel the impact of the AEC directly. In order to face the AEC, Indonesia must be in a conducive and qualified condition of including and not limited to the economic field, politic, technology, and etc. Therefore, Indonesia must ready to face the competition that wil be faced by Indonesia. One of which is to prepare the economic condition of Indonesia. The new regulations issued by the government of Indonesia through the Bank Indonesia is the obligation to use Rupiah. The purpose of this regulation itself is to stabilize the Rupiah and of course for the economic development of indonesia. Topic selection is based on one of the efforts of the Indonesian government to maintain and for the economic development of indonesia and of course stability of the rupiah in order to face globalizatian and of course the AEC. The purpose of this thesis is to review and analyze the result of the legal impact that will be faced with the issuance and enactment of Bank Indonesia Regulation No. 17/3/PBI/2015. The research method applied in this thesis is the normative approach with the statutory approach and conceptual approach / Dewasa ini, dapat dilihat bahwa perkembangan ekonomi daripada suatu negara, menjadi salah satu aspek esensial yang digunakan sebagai indikator untuk mengukur seberapa maju dan mapan suatu negara. Merupakan suatu ambisi yang tak terpungkiri dari negara-negara anggota The Association of Southeast Asian Nations (selanjunya ASEAN), untuk mengikuti jejak negara-negara anggota European Union (EU) untuk merealisasi suatu integrasi bukan hanya ekonomi, termasuk dan tidak terbatas pada politik, teknologi, dan lain-lain. Ambisi ASEAN adalah merealisasi suatu integrasi antara negara-negara anggota ASEAN, yaitu melalui Masyarakat Ekonomi ASEAN (selanjutnya MEA). Tentu saja, Indonesia sebagai negara anggota dari ASEAN akan termasuk di dalam MEA dan merasakan secara langsung dampak daripada MEA tersebut. Dalam rangka untuk menghadapi MEA, tentu Indonesia harus berada di dalam keadaan yang kondusif dan mumpuni termasuk dan tidak terbatas pada bidang ekonomi, politik, teknologi, dan sebagainya. Oleh karena itu, Indonesia harus siap untuk mengahadapi persainganpersaingan yang akan dihadapi Indonesia. Salah satunya adalah dengan mempersiapkan keadaan ekonomi Indonesia. Peraturan yang baru dikeluarkan oleh pemerintah Indonesia melalui Bank Indonesia adalah kewajiban penggunaan Rupiah. Tujuan dari peraturan ini sendiri adalah untuk menstabilkan Rupiah dan tentu saja untuk perkembangan ekonomi Indonesia. Pemilihan topik ini dilandaskan dari salah satu upaya dari pemerintah Indonesia untuk mempertahankan dan untuk perkembangan ekonomi Indonesia dan tentu saja kestabilan Rupiah dalam rangka menghadapi globalisasi dan tentu saja MEA. Tujuan penulisan skripsi ini adalah untuk mengulas dan menganalisa akibat-akibat hukum yang akan dihadapi dengan pengundangan Peraturan Bank Indonesia No. 17/3/PBI/2015 tersebut. Metode penelitian yang diterapkan dalam penulisan skripsi ini adalah dengan metode normatif dengan pendekatan undang-undang dan pendekatan konseptual.
