Abstract

The cyber law regime in Indonesia especially in the field of commercial transactions has touched the issue of legality of businessmen via electronic systems. The enactment of Government Regulation No.82 Year 2012 concerning Electronic System and Transaction Operation, obliges the businessmen to be certified when doing its business to public or private customers. This regulation was also cited in Law Number 11 Year 2008 concerning Electronic Information and Transactions, however it was not yet an obligation. The purpose of the obligation is to protect customers from being engaged in an online transaction with bad faith online businessmen. The certification provides guarantees of the individual businessmen as a legitimate seller under the eyes of the law and thus creating a trust mark for the customers. The purpose of this legal research is to go more in depth with how the obligation of businessmen via electronic system to be certified is regulated in prevailing Indonesian Laws and also to analyze what are the legal consequences of being certified for the businessmen. The result of this legal research will elaborate on the details of how certification of the businessmen via electronic system is regulated including the relevant bodies that are related to issue such certification and also giving the example of the legal impacts that may be attached to the businessmen once certified by the relevant governmental body / Rezim cyber law di Indonesia khususnya di bidang transaksi komersial telah menyentuh isu legalitas pengusaha melalui sistem elektronik. Berlakunya Peraturan Pemerintah Tahun 82 2012 tentang Sistem Transaksi Elektronik dan Operasi, mewajibkan pengusaha untuk disertifikasi ketika melakukan bisnis untuk pelanggan umum atau pribadi. Peraturan ini juga dikutip dalam Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik, namun itu belum merupakan kewajiban. Tujuan dari kewajiban adalah untuk melindungi pelanggan dari yang terlibat dalam transaksi online dengan itikad buruk pengusaha online. sertifikasi Menyediakan jaminan dari pengusaha individu sebagai penjual yang sah di bawah mata hukum dan Thus menciptakan tanda kepercayaan untuk pelanggan. Tujuan dari penelitian hukum ini adalah untuk pergi lebih mendalam dengan bagaimana kewajiban pengusaha melalui sistem elektronik akan disertifikasi diatur dalam Hukum yang berlaku di Indonesia dan juga untuk menganalisis apa konsekuensi hukum yang bersertifikat untuk pengusaha. Hasil penelitian hukum ini akan menguraikan secara rinci bagaimana sertifikasi dari pengusaha melalui sistem elektronik diatur Termasuk pihak terkait yang berhubungan dengan mengeluarkan sertifikasi tersebut dan juga memberikan contoh dampak hukum yang mungkin melekat pada pengusaha setelah disertifikasi oleh badan pemerintah yang relevan.
