Abstract
Technology has already becomes a part of every human life. Technology is needed to help people to their job or just for entertainment. Printer 3D is one of the technology that attracts people these days. Printer 3D have the ability to make a 3-dimensional object that already designed or made by the user on the computer. Unfortunately, uses of Printer 3D may result in Intellectual Property Right violations especially in field of Copyright law and industrial design. Indonesian law and international conventions are providing the protection for the creator or designer and copyright holder in case there is a violation of IPR. The protection is basically in form of exclusive right; kinds of protected creations; term of protection; registration system; and also a lawsuit. But the user of Printer 3D may have exemption from lawsuit if they use for personal interest; replace parts of spare-part of protected product; and make a design feature that allows the product to serve functionally or esthetically. Some of the exemptions are written on the law and come from judgment and decision. These exemptions are not easy to prove. The main reason is the law itself. It does not accommodate with the developing technology. Furthermore, Printer 3D is seen as a technology that facilitates the IPR violations, same as peer to peer (P2P) technology in Napster case / Teknologi telah menjadi bagian dari kehidupan manusia. Teknologi dibutukan untuk membantu orang-orang melakukan pekerjaan mereka atau sekedar untuk hiburan. Printer 3D adalah salah satu teknologi yang menarik perhatian banyak orang saat ini. Printer 3D memiliki kemampuan untuk membuat objek 3 dimensi yang sebelumnya sudah dirancang atau dibuat terlebih dahulu oleh pengguna dengan menggunakan komputer. Sayangnya, penggunaan Printer 3D dapat mengakibatkan pelanggaran Hak Kekayaan Intelektual khususnya pada bidang Hak Cipta dan Hak Desain Industri. Hukum Indonesia dan beberapa Konvensi Internasional menyediakan perlindungan bagi seorang pencipta atau desainer dan pemilik Hak Cipta apabila terjadi pelanggaran HAKI. Pada dasarnya, perlindungan yang diberikan berupa Hak Eksklusif; jenis ciptaan yang dilindungi; jangka waktu perlindungan; sistem pendaftaran; dan gugatan hukum. Namun, pengguna Printer 3D juga dapat diberikan pengecualian dari tuntutan hukum jika menggunakan untuk kepentingan pribadi; penggantian bagian dari produk sparepart atas produk yang dilindungi HAKI; dan desain fitur yang memungkinkan suatu produk untuk dapat berfungsi secara fungsional atau estetis. Beberapa pengecualian ini ditulis dalam Undang-Undang dan keputusan pengadilan. Pengecualian ini tidak mudah untuk dibuktikan. Alasan utamanya adalah dari hukum itu sendiri. Printer 3D dipandang sebagai teknologi yang memfasilitasi pelanggaran HAKI, sama seperti teknologi peer to peer dalam kasus Napster.
