Abstract

Indonesian Banking in running out the banking system is based on the principle of caution. In order to run the function, bank needs trust from the public to use the bank‟s service. But, these days there are a lot of bank fraud cases that happens because of the bank‟s employee themselves. Based on that, this research and study took the title of “The Responsibility Of The Bank In Ensuring the Certainty of Customer Funds Against Banking Crimes (Case Study Decision Number 170/PDT/2018/PT.DKI)”. The problems examined are related to the bank legal‟s liability for the losses that caused by the bank‟s employees‟ actions in relation to their employers and employees. We could see from the terms of Civil Law and Banking Law that is applicable in Indonesia and the application of law related to the bank‟s liability for the losses that is caused by the action(s) of the bank‟s employee with regards to the employers and some of the decisions made by the employees. This research is a normative Juridical research. The theory that is being used in this research is the theory that based on the liability of Civil Law due to the acts against the law (Tort). The results of this study conclude that bank‟s responsibility in terms of Civil Law will be based on the conduct of actions against the law because of negligence or because of the employer‟s responsibility for the actions of the employees. In the terms of Banking Law, banks have an obligations to carry out the principle of caution and good corporate governance in running out the business. Therefore, banks must be responsible for the losses that is caused by their employee(s).
