Abstract
Information technology is developing rapidly and the use of it has spreaded over several sectors. Fintech is an innovation of information technology which provides convenience in the financial sector, i.e. peer-to-peer lending. In accordance to that, fintech peer-to-peer lending is regulated under POJK No. 77/POJK.01/2016 (POJK 77), where such regulation is the first relevant regulation enacted in Indonesia. Consequently, this thesis is focused on the regulation of fintech peer-to-peer lending in Indonesia and the ideal regulation on fintech peer-to-peer lending. The regulation of fintech peer-to-peer lending in Indonesia contains provisions pertaining to the qualifications of peer-to-peer lending operator, registration and licensing, cooperation, mitigation of risks, consumer protection, application of anti-money laundering and counter-terrorism financing program, prohibitions on business activity, and regular reporting. The ideal regulation on fintech peer-to-peer lending shall be formulated by taking all positive aspects in the relevant regulation of China, UK, and Malaysia into considerations. Further, the formulation of the regulation concerning fintech peer-to-peer lending shall be done with both rule-based and principle-based approach. A number of provisions which shall be added to improve POJK 77 includes provisions pertaining to volume-based capital, differentiation of minimum lending limit between person and legal entity as well as among subjects who have obtained loans from several different operators, cooperation on information exchange with banks and other operators, publication of default rate, role of operator in case of default, and fintech peer-to-peer lending sharia. The Financial Services Authority (OJK) in Indonesia should observe the relevant regulations in other countries which have first regulated such matter. In addition to that, OJK shall also develop a communicative relationship with peer-to-peer lending operators.
